Rental car accident with the other driver at fault. What are my options?

Question:
My accident was a week ago today and I still have no answers and more importantly no car. There is a question with the rental agreement with the driver of the car and the person that rented the car. The rental car company is Hertz and there insurance company is Traveler's. What can I do to be compensated for this run-around and huge hassle?

Answer:
Rental companies are notoriously difficult to deal with.

I’d recommend going through your own carrier if you have the appropriate coverage (collision). They would cover your damages regardless of fault and then go after the other driver’s insurance (or the driver directly if it turns out he does not have insurance).

The plus of that? You get your car taken care of now.
The down of that? You would have to pay your deductible.

BUT – if your insurance company is able to recover from the other insurance company – you would get your deductible reimburesed.

That’s a plus, right?

“Hassle” and “run-around” are not legally compensable…..you might want to try to negotiate for something else. If they are going to have to put you in a rental for a week while your car gets repaired – see if they will upgrade your rental allowance….or pay you the allowance directly.
